Implementing a promotional activity in Italy requires a certain knowledge of what can be done, what cannot and the main legal promotional categories in Italy. This article does NOT provide legal assessment. <\/p>\n<\/div>\n\n\n\n

The following are the key promotional activities types under the Italian regulations: <\/p>\n\n\n\n

‘Concorso a premi<\/strong>‘<\/p>\n\n\n\n

<\/div>\n\n\n\n

A ‘Concorso a premi’ i<\/strong>s a promotional activity aimed at your product knowledge or advertising, based on the luck or the participant ability.<\/strong><\/p>\n\n\n\n

The following are the key legal procedures: <\/p>\n\n\n\n


1.-<\/strong> Terms and conditions must be created by the promoter <\/strong>of the activity.<\/p>\n\n\n\n

2.- <\/strong>Notary or legal T&Cs deposition are required<\/strong>.<\/p>\n\n\n\n

<\/p>\n\n\n\n

3.-<\/strong> A caution or an insurance covering the 100% of the total commercial value <\/strong>of assigned prizes is required.<\/p>\n\n\n\n

<\/p>\n\n\n\n

4.-<\/strong> It is required to inform the authorities 2 weeks prior to the beginning of the activity.<\/strong> The relevant authority is the Ministero dello Sviluppo Economico.<\/p>\n\n\n\n

<\/p>\n\n\n\n

5.-<\/strong> At the end of the activity, it is required to go through the Chamber of Commerce, for prize draw supervision & price acceptance from winners <\/strong>(those are 2 different steps) <\/p>\n\n\n\n

<\/p>\n\n\n\n

6.-<\/strong> You must then recommunicate to the Ministero dello Sviluppo Economico for the final form signage and taxes to be paid <\/strong>(c.ca<\/a> 45% of commercial prize value)<\/p>\n\n\n\n

<\/p>\n\n\n\n

In terms of taxes, the following are the key ones: <\/p>\n\n\n\n

a) 45% tax on commercial prize value <\/strong><\/p>\n\n\n\n

b) VAT becomes non deductible<\/strong> on the prize<\/p>\n\n\n\n

c) 25% Withholding tax on IRPEF<\/strong> (revenue tax) on behalf of the winners 

Heavy fines up to 500.000 Eur can be applied to promoters non carrying all legal procedures or paying all taxes. <\/p>\n<\/div>\n\n\n\n

‘Operazione a premi<\/strong>‘<\/p>\n\n\n\n

<\/div>\n\n\n\n

An ‘Operazioni a premi’<\/strong> is a promotional activity where all consumers buying a product receive a gift or benefit<\/strong>. Please note that a cashback does not fall into this category (see ‘iniziativa promozionale’ below) <\/p>\n\n\n\n

Key legal procedures for operazioni a premi are the following: <\/p>\n\n\n\n

1.-<\/strong> Terms and conditions must be created <\/strong>by the promoter of the activity.<\/p>\n\n\n\n

2.-<\/strong> Notary or legal T&Cs deposition are required<\/strong>.<\/p>\n\n\n\n

3.-<\/strong> A caution or an insurance covering a caution for the 100% of the total commercial value<\/strong> of assigned prizes is required, only in the case where the prize is deferred<\/strong> (consumer gets the prize after the promoted good purchase, not at the same time or before)<\/p>\n\n\n\n

4.-<\/strong> It is required to inform the authorities 2 days prior to the beginning of the activity.<\/strong> The relevant authority is the Ministero dello Sviluppo Economico.<\/p>\n\n\n\n

In terms of taxes, VAT becomes non deductible on the prize<\/strong>
<\/p>\n\n\n\n

‘Iniziativa promozionale’<\/strong><\/p>\n\n\n\n

<\/div>\n\n\n\n

An ‘Iniziativa promozionale’ is a promotion activity not falling into the first two categories. <\/strong><\/p>\n\n\n\n

Terms and conditions must be created by the promoter of the activity<\/strong>. It is advisable but not compulsory to register them in front of a notary.<\/p>\n\n\n\n

<\/div>\n\n\n\n

Cashbacks <\/strong><\/p>\n\n\n\n

<\/div>\n\n\n\n

Cashbacks can be considered deferred discounts and therefore they do not fall under the above categories. <\/strong>Terms and conditions must be created, and as it is as well advisable but not compulsory to register them in front of a notary. <\/p>\n<\/div>\n<\/div>\n\n\n\n
